COMMERCIAL PROPERTY

WITHIN A SSAS

  • Where the property is held by the employer, the SSAS can purchase the property providing a cash injection to the business

  • The employer could contribute the property to the pension attracting corporation tax relief on the contribution

  • Any borrowing required by the SSAS to acquire the property is off balance sheet debt for the company

  • The property is protected from creditors

  • Growth in the property value is exempt from capital gains tax

  • The commercial rent received is tax free. This will allow any borrowing to be paid off quicker compared to other ways of holding debt

  • Commercial property held in the pension is free from inheritance tax

  • In the event of death of the member, the property is easily passed on to beneficiaries, without the need to sell the asset or pay any death taxes

LOANS TO A

SPONSORING EMPLOYER

A SSAS can also make loans back to the sponsoring employer, up to 50% of the net scheme assets. This must be done on a maximum five year term, with capital and interest repayments. Suitable security must also be provided.
